These Terms of Service (“Terms”) govern the use of this website and the purchase of products from Sleep Design Beds LTD (“we”, “us”, “our”). By accessing our website or placing an order, you agree to be bound by these Terms.

1. Company Information

Sleep Design Beds LTD is a company registered in England and Wales.

2. Eligibility

By using this website, you confirm that:

  • You are at least 18 years old
  • You are legally capable of entering into binding contracts

3. Products

We sell beds, mattresses, and related furniture.

All descriptions, images, and specifications are provided for illustrative purposes only. While we aim for accuracy, slight variations in colour, size, or finish may occur.

We reserve the right to:

  • Modify or discontinue products without notice
  • Limit quantities of any product

4. Pricing & Payment

  • All prices are in GBP (£) and include VAT where applicable
  • Delivery charges (if applicable) will be shown at checkout
  • We reserve the right to correct pricing errors at any time

If a pricing error occurs:

  • We are not obliged to supply goods at the incorrect price
  • You will be offered the option to reconfirm or cancel your order

Payment must be made in full at checkout.

5. Orders & Contract Formation

A legally binding contract is formed only when we dispatch your goods, not when you place an order.

We reserve the right to refuse or cancel orders, including for:

  • Stock unavailability
  • Pricing or listing errors
  • Suspected fraudulent activity

If payment has been taken, a full refund will be issued.

6. Delivery

  • Delivery times are estimates and not guaranteed
  • Risk of loss passes to you upon delivery
  • Ownership of goods transfers only once full payment is received

You must ensure:

  • Accurate delivery details are provided
  • Adequate access for delivery

Missed deliveries or failed access may incur additional charges.

7. Consumer Cancellation Rights (Cooling-Off Period)

Under the Consumer Contracts Regulations 2013, you have the right to cancel your order within 14 days of receiving the goods.

To exercise this right:

  • You must notify us in writing (email is acceptable) within 14 days
  • You then have a further 14 days to return the goods

8. Returns Policy (Important)

Due to the nature of our products, the following conditions apply:

Standard Returns

We will only accept returns if:

  • The item is unused
  • The item is in original packaging
  • The item is unopened and sealed

Hygiene Exemption

Under Regulation 28(3)(a) of the Consumer Contracts Regulations:

👉 Mattresses and similar sealed hygiene products cannot be returned once unsealed/opened, unless faulty.

Deductions

We reserve the right to make deductions from refunds for:

  • Loss in value due to handling beyond what is necessary
  • Missing packaging

Return Costs

  • Customers are responsible for return shipping costs unless goods are faulty or incorrect

9. Faulty, Damaged or Not as Described Goods

Under the Consumer Rights Act 2015, you are entitled to:

Short-Term Right to Reject (30 Days)

You may reject goods within 30 days if they are:

  • Faulty
  • Not as described
  • Not fit for purpose

You will be entitled to a full refund.

Repair or Replacement

After 30 days, we may offer:

  • Repair or replacement

If unsuccessful, you may be entitled to a refund (which may be reduced based on usage).

You must notify us within 48 hours of delivery for damage in transit.

10. Refunds

Refunds will be processed:

  • Within 14 days of receiving returned goods, or
  • Within 14 days of proof of return

Refunds will be issued via the original payment method.

11. Warranty

Some products may include a manufacturer’s warranty. This is in addition to your statutory rights.

The warranty does not cover:

  • Normal wear and tear
  • Accidental damage
  • Misuse or improper assembly

12. Limitation of Liability

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Breach of statutory rights

Subject to the above:

  • Our liability is limited to the purchase price of the goods
  • We are not liable for indirect or consequential losses

13. Website Use

You agree not to:

  • Use the website for unlawful purposes
  • Introduce malicious software
  • Attempt unauthorised access to systems

We may suspend or terminate access if these Terms are breached.

14. Privacy & Data Protection

We process personal data in accordance with UK GDPR and the Data Protection Act 2018.

15. Changes to Terms

We reserve the right to amend these Terms at any time. Updated Terms will be posted on this page.

16. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
